1) Purchase Proposal
If you are sure that the house you have found is the right one for you, then you need to make the Purchase Proposal in writing to the owner. In the Written Proposal, a certain price is proposed for the purchase of the property, which will be described in detail with all the cadastral data and origin, the payment conditions will be proposed and a deadline for the final purchase will be established.
With the purchase proposal you will then be obliged to go ahead with the deed of sale, if the seller accepts it.
2) Preliminary Purchase or Compromise
Once the offer has been accepted in all its parts, the offer itself is registered and we move on to the preliminary contract.
The Preliminary is used to allow the conclusion of the definitive contract, in fact the ownership of the property is not transferred, but one is only obliged to transfer it at a later time. Furthermore, all the conditions anticipated in the Purchase Proposal are detailed in the Preliminary, including the details of the parties, the characteristics and cadastral data of the property, the cost and methods of payment, the date of signing the deed with relative delivery of the motionless.
The Preliminary is accompanied by a deposit which is given to the seller as a reciprocal guarantee. If the buyer decides not to purchase after having paid the deposit, he will lose it. If, on the other hand, it was the seller who defaulted, he will have to return the sum and double the amount paid.
3) Notarial deed
The notarial deed is the final deed of the sale process through which the property transfers.
It is conducted by a notary, who draws up the deed, reads it aloud and finally has it signed by both the buyer and the seller.
