Who pays the real estate agent's commission?

The real estate agent acquires the right to the commission as soon as the parties, put in contact by him, stipulate the preliminary contract, which leads them respectively to buy and sell.

Regardless of who first applied to the agency, the payment of the commission, in most cases, is the responsibility of both parties, seller and buyer, and is made when the deal is concluded.

If the deal does not materialize due to the broker's fault, in this case no commission should be paid to him.

Also keep in mind that the broker may be entitled to commission even if he has not established a contract between the parties.

It could happen, for example, that, after the compromise has been established, one of the contracting parties has second thoughts and does not complete the sale.

In this case, the mediator still has the right to compensation.

It is important that these aspects are clearly clarified in the initial contract with the real estate agency.
